Mexico LFPDPPP: Privacy Notice, ARCO, Consent, Transfers

Understand LFPDPPP essentials: build compliant privacy notices, honor ARCO rights, obtain valid consent, and manage data transfers. Practical tips and tools.

Under Mexico's LFPDPPP, your privacy notice must be clear, complete, and available before collecting data. Articles 15-16 and the Privacy Notice Guidelines require you to state the controller's identity and address, primary and secondary purposes, options to limit use/disclosure, ARCO procedures, transfers, consent/revocation mechanisms, and tracking technologies (cookies/web beacons). Use layered notices (integral, simplified, and short) tailored to the context, and keep evidence of delivery. LegalDocs.ai helps generate bilingual, compliant notices and version them, so updates and purpose changes are documented.

Operationalize ARCO rights (Acceso, Rectificación, Cancelación y Oposición) with simple request channels and identity verification. LFPDPPP Arts. 28-35 set deadlines: respond within 20 days and, if granted, fulfill within 15 days; one justified extension is allowed. Provide cost-free processing except for justified reproduction costs, and keep a log of requests and outcomes. Name a data protection lead, publish contact details in the notice, and standardize forms. LegalDocs.ai streamlines ARCO workflows, timestamps responses, and retains evidence for INAI audits.

Obtain consent appropriately. Per Art. 8, consent may be tacit when you provide the notice and no objection is raised; express consent is required for financial or patrimonial data, and Art. 9 demands express written consent for sensitive data. Offer opt-outs for secondary purposes like marketing at collection and in every message. For transfers, Arts. 36-37 require informing recipients of the notice and ensuring they assume equivalent obligations; get data subject consent unless an exception applies (e.g., intra-group, legal requirement, or contract). LegalDocs.ai tracks consents and automates transfer agreements.
